Terms of Use

These Terms of Use (“Terms”) govern your use of the Presented mobile application (“the App”), operated by WebSab (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

Presented is a birthday reminder and gift planning app for iOS.

Without an account, the App lets you:

• Store names, birthdates, and photos of people whose birthdays you want to remember
• Receive reminders before upcoming birthdays
• Create and manage gift notes with text and photos
• Import birthday information from your device's contacts

If you choose to sign in, the App additionally lets you:

• Create a public profile with a display name, @handle, birthday, bio, and photo
• Find other people and send and receive friend requests
• Share a wish list with the friends you have accepted
• Receive notifications about friend activity

Signing in is optional. Everything in the first list works without an account.

2. Eligibility

The birthday and gift planning features of the App are available to users of all ages. If you are under 16, we recommend a parent or guardian reviews these Terms and supervises your use.

The social features — creating a profile, appearing in search, and adding friends — require you to be at least 16 years old. By creating a profile you confirm that you are 16 or older. We may remove any profile we reasonably believe belongs to someone under 16.

3. Your Account

Accounts are created through Sign in with Apple. You may hold one account, and you may not create an account on someone else's behalf or impersonate anyone.

You are responsible for the content of your profile, including your display name, @handle, bio, and photo, and for activity that takes place under your account. Your display name and @handle are publicly searchable by other users of the App; choose them accordingly.

You can delete your account at any time from within the App, under Settings. We may suspend or terminate an account that breaches these Terms, as described in section 7.

4. Purchases

Presented Pro

The App offers a free tier with core functionality. A one-time purchase, “Presented Pro,” unlocks:

• Unlimited people (the free tier is limited to five)
• Up to twenty wish list items per person
• Custom reminders beyond birthdays
• Per-person reminder preferences and delivery times

Presented Pro is a one-time purchase, not a subscription. It does not renew, and it remains unlocked through future updates.

Payment and Billing

All purchases are processed through the Apple App Store. By making a purchase you agree to Apple's App Store Terms of Service. Payment is charged to your Apple ID at the time of purchase.

Refunds

Because Presented Pro is bought through Apple, refund requests must go to Apple through their standard refund process. We do not process payments or refunds directly.

5. Your Content

Ownership

You retain full ownership of everything you create or import into the App, including names, photos, gift notes, wish list items, and your profile (“User Content”).

License

For User Content that stays on your device, we need no licence and take none.

For User Content you choose to share by signing in — your profile and your shared wish list — you grant us a limited, non-exclusive, royalty-free licence to store, reproduce, and display that content solely for the purpose of operating the App: showing your profile in search, and showing your profile and wish list to the friends you have accepted. This licence exists only to run the service, extends no further, and ends when you delete the content or your account.

Responsibility

You are responsible for your User Content and for making sure you have the right to share it. Do not upload photos of other people without their agreement.

6. Acceptable Use

We have no tolerance for objectionable content or abusive behaviour.

You agree not to use the App to:

• Harass, bully, threaten, stalk, or intimidate anyone
• Post or share content that is hateful, discriminatory, violent, or sexually explicit
• Post or share any sexual content involving minors, or any content that exploits or endangers children
• Impersonate any person or organisation, or misrepresent your identity or age
• Share another person's private information without their consent
• Send unsolicited, repetitive, or bulk friend requests, or otherwise spam other users
• Upload malicious code, or attempt to gain unauthorised access to the App, our servers, or another user's account
• Scrape, harvest, or bulk-collect other users' profiles or information
• Use the App for any unlawful purpose, or to infringe anyone's rights
• Reverse engineer, decompile, or disassemble the App, or create derivative works from it
• Remove or alter any proprietary notices or marks

7. Reporting, Blocking, and Enforcement

Reporting

If you encounter a profile, photo, wish list, or friend request that breaches section 6, you can report it from within the App. You can also email hello@websab.nl.

We review every report and act within 24 hours. Depending on what we find, we may remove the content, suspend the account, or terminate it permanently.

Blocking

You can block any user from within the App. Blocking removes any existing friend connection, prevents that person from finding you in search or sending you further requests, and hides your profile and wish list from them.

Enforcement

We may remove content or suspend or terminate an account that breaches these Terms, with or without notice, and we may report unlawful content to the relevant authorities. If your account is terminated for a breach, you may not create a new one.

8. Notifications

The App sends reminders about upcoming birthdays from your device, and — if you sign in and enable them — push notifications about friend activity.

Delivery depends on your device settings, iOS system limitations, network availability, and device state such as battery level or Focus modes. We do not guarantee that any notification will arrive at a particular time, or at all, and we are not liable for missed, delayed, or undelivered notifications.

9. Intellectual Property

The App, including its design, code, graphics, icons, and branding, is the intellectual property of WebSab and is protected by copyright and trademark law. These Terms grant you no rights to our intellectual property beyond the limited right to use the App as intended.

10. Availability and Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or secure, that defects will be corrected, that the App will meet your requirements, or that notifications will be delivered reliably. The social features depend on network connectivity and third-party infrastructure, and may be unavailable from time to time.

Nothing in these Terms limits any rights you have as a consumer under mandatory Dutch or EU law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WebSab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

Our total liability for any claim arising from or relating to these Terms or the App shall not exceed the amount you paid for Presented Pro, or €10, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless WebSab from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your breach of these Terms.

13. Termination

You may stop using the App at any time by deleting your account in Settings and uninstalling the App. We may suspend or terminate your access as described in section 7, and we may discontinue the App or change its features at any time.

If the App is discontinued, your locally stored data remains on your device.

14. Apple

These Terms are between you and WebSab, not Apple, and WebSab alone is responsible for the App and its content. Apple has no obligation to provide support or maintenance for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

15. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Disputes arising from these Terms or your use of the App shall be resolved by the competent courts in the Netherlands. If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, and you may also use the European Commission's online dispute resolution platform.

16. Changes to These Terms

We may update these Terms. When we make a material change, we will update the date shown at the top of this page and, where the change significantly affects you, tell you in the App. Continued use after a change means you accept the updated Terms.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
